Sub:  STRIKES  - Strike Notices served on VC & MD by Joint Action Committee consisting of APSRTC Employees Union, APSRTC Staff & Workers Federation, APSRTC Karmika Sangh, APSRTC Karmika Parishad & APSRTC Rashtriya Mazdoor Federation and APSRTC National Mazdoor Union (Recognised) proposing to call upon all the employees of APSRTC working in different units/depots/offices through out the State to go on indefinite strike commencing from 05.01.2010 and 06.01.2010 respectively  –  Guidelines – Issued.

Individual Strike Notices dated 26.11.2009 have been served on VC & MD by APSRTC Employees Union, APSRTC Staff & Workers Federation, APSRTC Karmika Sangh, APSRTC Karmika Parishat and APSRTC Rashtriya Mazdoor Federation with a charter of 17 common demands on Revision of Pay Scales & Allowances and other service conditions, proposing to call upon all the employees of APSRTC to go on indefinite strike commencing on or after 10.12.2009 for redressal of the grievances furnished in the Annexure to the Strike Notice.  Subsequently, they have formed into Joint Action Committee and requested to discuss with the JAC on the issues incorporated in the Strike Notices.

 

            The APSRTC National Mazdoor Union (Recognised) served Strike Notice dated 27.11.2009 with a charter of 10 demands on Revision of Pay Scales & Allowances and other service conditions, proposing to call upon all the employees of APSRTC working in different Units/depots/Offices throughout the State to go on indefinite strike commencing on or after 11.12.2009 for redressal of the grievances furnished in the Annexure to the Strike Notice.

 

            The Recognised APSRTC National Mazdoor Union submitted its proposals on 27.02.2009/03.03.2009 for Revision of Pay Scales & Allowances and other Service Conditions of the employees.  The Corporation Board constituted a Negotiating Committee to negotiate with the Recognised Union on the proposals submitted by them.  The Negotiating Committee held discussions on 03.06.2009, 22.06.2009, 29.07.2009, 02.09.2009, 19.11.2009, and 21.11.2009 with the Recognised APSRTC NMU.  The Union has proposed for allowing 50% fixation benefit on pre-revised pay and merging of DA as on 01.01.2009 initially.

 

After detailed deliberations on the financial position of the Corporation, the Negotiating Committee offered 15% fixation benefit.  A Sub-Committee consisting of some Officers and Union Representatives was constituted to discuss the issues pertaining to Service Conditions pertaining to the Employees contained in the proposals submitted by the Union and submit its recommendations to the Negotiating Committee for consideration.  Accordingly, continuous meetings were held by the Sub-Committee from 03.12.2009 to 05.12.2009 and submitted its recommendations to the Negotiating Committee.

 

The Commissioner of Labour convened Conciliation meetings on the Strike Notice, dated 27.11.2009 served by APSRTC NMU on 11.12.2009 & 14.12.2009. The Commissioner of Labour closed the Conciliation Proceedings on 26.12.2009 as having failed, since there was no meeting point between the parties.

 

The Commissioner of Labour convened Conciliation meetings on the Strike Notices, dated 26.11.2009 served by JAC of Unions on 18.12.2009.  The Commissioner of Labour closed the Conciliation Proceedings on 26.12.2009 as having failed, since there was no meeting point between the parties.

 

The Joint Action Committee informed through the letter dated 29.12.2009 that they have decided to go on indefinite strike from the First Duty of 05.01.2010.  It is also reported in a section of the press that the APSRTC National Mazdoor Union has decided to go on indefinite strike from 06.01.2010.

 

          The Government of A.P. through G.O.Ms.No.147, dt.04.07.2009 issued orders prohibiting Strikes for a period of six months w.e.f. 06.07.2009 in any service under the Andhra Pradesh State Road Transport Corporation, in exercise of the powers conferred by Sub-Sections (1) and (3) of Section-3 of the Andhra Pradesh Essential Services Maintenance Act, 1971 (Act 20 of 1971).   Hence, the proposed strike will be treated as ‘ILLEGAL STRIKE’. 

 

        However, in the event of strike getting materialized, the following instructions/ guidelines are to be followed by all the Officers of the Corporation.

 

1)        All the employees who are on sanctioned leave before the date of receipt of the Circular should be called back and asked to report for duty.  However, the Executive Director of the Zone concerned and ED(A&P) in Head Office, may sanction leave in emergency and any extra-ordinary cases.

 

2)        As the strike is illegal, wages for the day(s) of strike shall be deducted from the Salary of January 2010 in respect of those who participate in the Strike.

 

3)     Separate attendance register/control charts shall be maintained for the days of strike and the employees who participate in the strike shall be marked ‘ABSENT’. The attendance register/control charts must be kept separately under the personal custody of the Unit Officer. An entry in RED INK shall be made in the Service Registers of striking employees as "PARTICIPATED IN THE ILLEGAL STRIKE".

 

4)        Services of the employees who are on contract/casual basis need not be continued, if they join the illegal strike.

 

5)        Services of the employees appointed under Reg.17 need not be continued, if they participate in the illegal strike.

 

6)        The employees who are on probation are liable for reversion to their substantive post, if they participate in the strike. 

 

7)        Employees promoted under Reg.30 are liable for reversion, if they participate in the strike. 

 

8)        Employees under probation in their first appointment are liable for termination of their probation, if they participate in the strike.

 

9)        Employees who participate in the strike are liable for prosecution under Section 4 of A.P. Essential Services Maintenance Act, 1971.

 

10)    A copy of this Circular shall be exhibited on the Notice Boards of all the Units/Depots.

 

11)    Necessary security measures shall be taken to protect the Corporation properties.     Local Revenue and Police Authorities shall be contacted for necessary assistance and Police Bandobust.

 

12)    The Personnel Officers of the Regions shall send a report on the Strike covering the particulars of No. of employees participated in the Strike category-wise, untoward incidents, if any, Police cases booked with details of each case daily, at 11.00 hours and 16.00 hours from 05.01.2010 onwards till the strike is called off, in the proforma, as at Annexure-A to the Dy.Chief Personnel Managers of the Zones and to Dy.Chief Personnel Manager (IR&W)/HO through FAX/Telephonic Message without fail.

 

13)    The Dy.CPMs of the Zones shall furnish the information in respect of Non-operational Units in Annexure-“A”. While furnishing the above information, the Dy.CPMs of the Zones, shall also furnish the consolidated information in respect of the Regions under their jurisdiction by 11.00 hours and 16.00 hours invariably in the proforma as at Annexure-“A” to the Dy.Chief Personnel Manager (IR&W)/HO through FAX No.040-27616268 Telephone No.040-27615220.

 

14)    Furnishing the above information in the Annexure-A is the total responsibility of the Personnel Officers of the Regions and Dy. Chief Personnel Managers of the Zones. If the information is not flashed to Head Office at the timings specified, the POs of the Regions and DY. CPMs of the Zones will be personally held responsible for the delay. In this regard, the DMs/WMs and Other Unit Officers shall take personal interest and furnish the information in the Annexures-A to the concerned POs/Dy.CPMs to enable them to furnish the information at specified hours.

 

15)    The attendance particulars relating to Head Office by PO.II, Tarnaka Hospital by Supdt, BBW & Printing Press by LW&IRO/BBW and Transport Academy by Principal, shall be furnished daily by 11.00 hours to the Dy. Chief Personnel Manager (IR & W)/ Head Office in Annexure-"A".

 

16)    Immediately after completion of strike, the information relating to attendance particulars in Annexure-"A" and Operational details in Annexure-“B" enclosed to this Circular, should be sent to the Dy. Chief Personnel Manager (IR&W) by    PO-II/LW&IRO (BBW)/ Supdt. / Principal, TA, HPT / POs of Regions/Dy.CPMs (Zones).

 

17)    At Zonal Office/Regional Office, separate Communication Cell arrangements shall be made with necessary staff to work round the clock during the days of Strike.

 

18)    Detailed instructions will be issued by Operations Department on operation of services.
