Sub: SERVICE REGULATIONS–Implementation of amended Reg.6A (5)(b) of APSRTC Employees (Service) Regulations, 1964 providing better benefits to Medically Unfit Drivers – Reg.

In terms of amended Regulation 6A(5)(b) of APSRTC Employees (Service) Regulations, 1964 notified through the Notification 1st cited, a Driver retired on medical grounds is entitled to all terminal benefits and Addl. Monetary Benefit in lieu of alternative employment.

Detailed guidelines were issued through the Circulars 2nd  and 3rd  cited on implementation of amended Reg.6A(5)(b) of APSRTC Employees (Service) Regulations, 1964 w.e.f 08.10.2003 for those Drivers who are found medically unfit and opt for revised Addl. Monetary Benefit in lieu of alternative employment.

As per the instructions in vogue, when a Driver requests for retirement on medical grounds on any illness, he shall be straight away directed to Supdt., APSRTC Hospital, Tarnaka with MTD 430, with a request to place his case before the Medical Committee for assessing his suitability for the post of Driver.  Thus a situation has arisen where the Medical committee, has to directly examine the driver without any preliminary level of Scrutiny. In view of large number of Drivers approaching the Medical Committee directly, it has been decided to subject all such drivers who want retirements on medical grounds, to a preliminary level of scrutiny at Medical officer level.

It is observed that a large number of Drivers, who are able bodied, are made unfit to hold the post of Driver, because of their visual disability. It has been decided to offer only alternative employment to such Drivers and not Additional Monetary benefit.

As per the existing guidelines, all the Drivers who are found unfit by the Committee are to be provided with Additional Monetary Benefit and the Drivers who are found unfit at the review authority i.e., Medical Board, are offered with either alterative employment or Additional Monetary Benefit. To have uniformity, it has been decided to empower the Medical Committee to offer alternative employment.

Therefore, the following revised instructions are issued for compliance

1.    When a Driver requests for retirement on medical grounds on any illness, he shall be directed to Medical officer.  If he is found unfit by the Medical officer, then he shall be directed to Supdt., APSRTC Hospital, Tarnaka with MTD 430, with a request to place  his case before the Medical Committee for assessing his suitability for the post of Driver.

2.      In case the Driver is found fit by the medical Committee, he shall be taken back on duty. If he is found unfit to the post of Driver, because of physical disability other than visual disability, he shall be offered Additional Monetary Benefit. If he is found unfit to the post of Driver, because of visual disability, he shall be given only alternative employment.

3.    If a Driver is found unfit because of some diseases, which are curable, he shall be directed for treatment. The Drivers, who are not willing to undergo treatment, shall be given alternative employment and not additional monetary benefit.

            The instructions issued through the circular 2nd and 3rd    cited are modified to the extent indicated above and will come into force with immediate effect.
