SUB: - CONDUCT REGULATIONS: Retirement of Officers and Employees of APSRTC without taking any action in Vigilance cases – Settling the retirement benefits on receipt of clearance  certificate from the Vigilance Department – Inclusion of Vigilance certification through Retirement Notification – Instructions issued – Reg.

The Vigilance Department has taken a serious note on the following points:

 

a)                 After conducting  Vigilance enquiry, the EDs/RMs are being advised to take disciplinary action / recovery  of loss caused to the Corporation from the Officers/ Employees concerned in such cases

b)                 But, no action is being taken at the Regions/Zones for years together in spite of issuing several reminders from Head Office and in most of the cases, the action taking authorities have been reacting lately and informing that no action can be taken by saying that those Officers/Employees have retired from the services of the Corporation on attaining the age of superannuation

c)                 In some cases, when they intend to take action, the period of leftover service before  the retirement is very less i.e. one month or days or so and hence action for imposing punishment/recovery of loss amount etc., cannot be completed since principles of natural justice have to be complied with invariably

 

In view of the above, all the Unit Officers are hereby advised to request the Vigilance Department for information regarding pending vigilance cases or recoveries to be made that are arising out of such vigilance cases while calling for the no dues certificates from all the units wherever the Officer/Employee has worked through the Retirement Notification itself.

 

Upon receipt of such Retirement Notification, the Director (V&S) shall arrange to verify the records and issue certification on pending vigilance cases if any, in respect of Officers within 15 days and the Joint Director (V&S) shall arrange to issue such certification on pending vigilance cases if any, in respect of employees belonging to Class-II, III & IV cadres.

 

The Unit Officers shall expeditiously act on finalizing the action proposed by the Vigilance Department, considering the short period of less than six months available before the Officer/Employee retires since date of issue of retirement notification.

 

The settlement authority of the retiring employee shall finalize the settlement salary bill/encashment of terminal leave only on receipt of clearance certification on pending vigilance cases if any, from the Vigilance Wing of Head Office, since PF & Gratuity cannot be withheld in normal circumstances.

 

If the clearance certificate is not received from the Vigilance Wing of Head Office   within six months from the date of retirement notification or as on the date of retirement of Officer/Employee concerned, such cases shall be settled duly treating that no vigilance cases are pending as on date of retirement of the officer/employee.

 

If the Disciplinary Authorities are not responding even on receipt of any pending vigilance cases of particular Officer/Employee, then action has to be initiated on the Disciplinary Authority or recovery shall be made from the Disciplinary Authority concerned while the Officer/Employee shall be allowed to retire normally.
