            The Government of Andhra Pradesh in the G.O 1st cited issued guidelines to be observed in all work places for the preservation and enforcement of the right to gender equality of the working women based on the guidelines laid down by the Hon’ble Supreme Court to prevent sexual harassment of working women.

 

            The Government of Andhra Pradesh through G.O 2nd cited had incorporated a specific provision in their Andhra Pradesh Civil Services (Conduct) Rules 1964 for “Prohibition of sexual harassment of working Women”.

 

            To fall in line with the Government pattern, the Board through the Resolution No.18/2002, dated 25.01.2002 had accorded approval for incorporation of a new Regulation as Reg.22 (A) in APSRTC Employees’ (Conduct) Regulations 1963 prohibiting sexual harassment of working women.  The Special Chief Secretary to Government, T, R&B Department conveyed the sanction of the Government for incorporation of new Regulation as resolved by the Board.  The New Regulation was notified through Notification 3rd cited for implementation.

 

            It was stipulated in the G.O 1st cited that an appropriate complaint mechanism should be created in the Employer’s Organisation for redressal of the complaint made by the victim, whether or not such conduct constitutes an offence under law or a breach of the service rules.  Accordingly, a Complaints Committee was constituted as per the guidelines issued through G.O 1st cited for a period of one year in order to elicit whether or not such conduct constitutes an offence under Reg.22 (A) of APSRTC Employees’ (Conduct) Regulations, 1963 prohibiting sexual harassment of working women and communicated through Office Order 4th cited to all Officers of the Corporation.  The Complaints Committee was reconstituted every year till 2009 and communicated to all Officers of the Corporation.

 

            In order to ensure time bound treatment of complaints, it is decided to constitute Complaints Committees at Regional level also.  Accordingly, the following instructions are issued for implementation and compliance.

 

  1. All the Regional Managers shall constitute Complaints Committees with 5 Members headed by a Woman in the rank of Depot Manager or Supervisor and not less than half of its members should be women.  One Member shall be from the category of Lady Conductors.  Further, to prevent the possibility of any undue pressure or influence from senior levels, such Complaints Committee should involve a third party, either Non Governmental Organisation or other body who is familiar with the issue of sexual harassment.  One of the Members shall be made Convener.

 

  1. The Complaints Committee shall meet once in three months provided any complaints are received or at the discretion of the Chairperson, to elicit whether or not such conduct constitutes an offence under Reg.22 (A) of APSRTC Employees’ (Conduct) Regulations 1963 and submit its report to the appointing authority of the offender for taking appropriate disciplinary action.  The Complaints Committee shall send its report of the complaints and action taken thereon to the Regional Manager concerned once in a quarter.

 

  1. A Report shall be submitted by the Regional Manager concerned to the Executive Director(Zone) concerned in the enclosed proforma once in a quarter.  For the quarters ending March, June, September & December, the report shall be submitted before 5th of April, July, October & January.

 

  1. The ED(Zone) concerned shall submit a consolidated Annual Report in the enclosed proforma by 15th of January of the following year to VC & MD.

 

  1. A copy of the G.O.1st cited is enclosed for guidance.

 

The Complaints Committees shall be constituted forthwith and start functioning immediately.
