Sub:-   CC&A REGULATIONS – Initiation of disciplinary proceedings against the employees who do not report for duty on transfer within the stipulated time – Instructions Issued- Reg.

Of late, instances have come to notice wherein no disciplinary action   has been initiated against the employees who are relieved from one Unit on transfer, but failed to report at the transferred Unit. It is noticed that such employees are continued on rolls for years together and the fact came to light only on their death and when the dependents of such employees made claims seeking settlements. In one such case, an employee remained absent for 11 years and was continued on rolls without initiating any disciplinary action. Since the employee is on rolls as on the date of his death, it had to be treated as death in service case and all the benefits are to be paid to the dependents. The failure on the part of the Unit Officers is leading to such irregularities.

 

Through circular cited, instructions were issued on the procedure to be followed for initiation of disciplinary action against an employee, who did not report at the new Unit, after having been relieved from old Unit on transfer.  As per the instructions, the next higher authority will have the jurisdiction, if the transfer is from one Unit/Office to the other, within his/her administrative jurisdiction. For instance, if an employee is transferred from one Office / Unit to the other Office / Unit within the Region, the Regional Manager concerned will have the jurisdiction over such employee, to initiate disciplinary action for non-reporting for duty at other Unit/Office. Similarly, if an employee is transferred from one Region/NOU to the other Region/NOU within the Zone, the Executive Director concerned will have the jurisdiction over such employee. In case of an employee transferred from one Zone to other Zone, the Executive Director (Administration) will have jurisdiction.

 

In view of the lapses noticed, the following instructions are issued for strict compliance:

 

1.      Whenever an employee does not report at the new station, after having been relieved at the old station within the stipulated time, the Unit Officers of both the Offices / Units should report the matter to the authority who has issued transfer orders to such employee, so as to take disciplinary action.

2.      The Dy Chief Personnel Managers (Zones)/Personnel Officers (Regions) should monitor for implementation of transfer orders issued by Executive Director (Zone)/Regional Managers respectively. They should process for initiation of disciplinary action against the employees who do not report at the new station, after having been relieved at the old station within the stipulated time.

3.      The transfer orders issued by the Corporate Office shall be monitored for implementation by Dy Chief Personnel Manager (A)/Personnel Officer – II in respect of Officers/other employees respectively. They should process for initiation of disciplinary action against the Officers/other employees who do not report at the new station, after having been relieved at the old station within the stipulated time.

4.      The Dy Chief Personnel Managers/Personnel Officers should review the status of implementation of transfer orders in the meeting of Personnel Officers and PD Supervisors respectively.

5.      Any deviation of these instructions will be viewed seriously.
