Sub: SETTLEMENTS – Settlement of Terminal benefits expeditiously to the Officers/Employees or their families after cessation of employment on account of Retirement, Resignation, Death etc. - Delay in settlements – Instructions reiterated.

            Instructions were issued many a time to arrange settlement of terminal benefits expeditiously to the employees or their families after cessation of employment on account of retirement, resignation, death etc.

            With a view to ensure that the settlements of the employees are finalized and payments are arranged with out any delay, detailed instructions were issued through Circular 1st cited as to how to settle Gratuity, PF, SBT Fund, Leave Encashment and Settlement Salary etc.

            Further, instructions were issued through Circular 2nd cited that no departmental or non-departmental dues can be deducted from the Gratuity payable except under the circumstances for which Gratuity may be forfeited as per Sec.4(6) of “Payment of Gratuity Act 1972” and the procedure to be followed in recovering the departmental dues.

            Instructions were also issued through Circular 3rd cited on the procedure to be followed in settlement of PF, FPS/EPS & EDLIF in respect of retired/deceased employees.

            Revised guidelines were issued through Circular 4th cited on the procedure to be followed to compute the qualifying service for calculating the amount of Gratuity.

            In spite of issuing instructions/guidelines procedure to be followed in settling the terminal benefits to the retired/deceased employees and also clarifying the doubts expressed by the Unit Officers from time to time, instances have come to notice that settlements are being unduly delayed in some cases, with the result, the employees and the bereaved families of deceased employees are being subjected to severe financial hardship and misery.

            All the Unit Officers are hereby advised to follow scrupulously the instructions issued through circulars cited and other instructions issued from time to time on the subject and ensure that the settlements in respect of retired/deceased employees are finalized and payments are arranged expeditiously.       

            Deviation of these instructions will be viewed seriously and the responsibility for the consequences that would arise due to non-settlement of terminal benefits in respect of ex-employees lies with the Unit Officer concerned.
