Sub:  CONTRACTS - Payment of Minimum Wages to the Labour engaged by the Contractors - Regarding.

           The Corporation is entrusting various works to private contractors on work contract basis. It is mandatory for the Contractors to pay not less then minimum wages to the labour engaged by them as notified by the Government from time to time, and as the  “Principal Employer” the Corporation is obligated to ensure payment of such minimum wages.   

 

          Instructions have been issued in this regard vide Circular 1st cited, advising the Unit Officers to ensure payment of minimum wages, at the rates as prescribed by the State Government from time to time, to the labour engaged by the Contractors.  It was also stipulated therein that the rates of minimum wages shall be obtained either from the Labour Department or from the District Collectorate at frequent intervals and it must be ensured that the Contractors shall pay the minimum wages prescribed by the Government. 

 

          The Commissioner of Labour, AP/HYD through the Notification 2nd cited, published in the AP Gazette, has revised the minimum wages payable to the Contract Labour engaged by the contractors w.e.f. 18.08.2009 as follows.

          All the Unit Officers are, therefore, advised to ensure that the Contractor pays not less than the above revised minimum wages to the Contract Labour engaged by him per month with effect from 18.08.2009, subject to revision as may be notified by the Commissioner of Labour, A.P., from time to time.

 

            The existing contractors shall also pay not less than the above revised minimum wages to the Contract labour engaged by them w.e.f. 18.08.2009 for the remaining period of their contracts and to that extent revised agreements are to be entered in to with such contractors.

 

          The Unit Officers shall also ensure that a representative of the Corporation in the rank of Supervisor witnesses payment of Minimum Wages to the Contract Labour and maintains a record to this effect.

 

          In case of any complaints on the non-payment of minimum wages, the matter shall be viewed seriously and the Unit Officer concerned will be held responsible for violation of instructions.

 

          All the Unit Officers are, therefore, advised to follow the above instructions scrupulously.
