Instructions were issued vide references 1^st & 2^nd cited regarding submission of draft Voters lists to the Dy.Commissioners of Labour concerned etc., in connection with the Union Membership Verification in APSRTC.

            Consequent to the above, the Chief Returning Officer & Addl. Commissioner of Labour, Hyderabad convened a meeting on 30.11.2012 with the Management of APSRTC and Trade Unions functioning in APSRTC to finalize the election programme for verification of Union Membership.

            The following is the programme of verification of Union Membership, as communicated by the Chief Returning Officer and Addl. Commissioner of Labour through letter 4^th cited—

            1)         Date of Reckoning                                                        : 01.11.2012

2)         Date for filing objections, if any, by the Unions, on

the list of employees already submitted to the DCLs

concerned.                                                                   : 04.12.2012

            3)         Date of submission of list of employees transferred/

                        retired/resigned/removed/dismissed/terminated/

                        expired   after   date   of   reckoning,  by  the  Unit

Officers/Depot Managers to the DCLs concerned.        : 06.12.2012

            4)         Supply of final list of employees along with total

                        complement to the Unions by the DCLs concerned. : 10.12.2012

The following are the Unions contesting as communicated by the Chief Returning Officer & Addl. Commissioner of Labour, Hyderabad through the letter 4th cited:

A)  List of Unions contesting in the Operational Regions of Krishna, West-Godavari and East-Godavari only.

B)     List of Unions contesting in the Operational Regions of i) North East Coastal ii)Visakhapatnam iii) Guntur iv) Ananthapuram v) Kurnool vi) Kadapa vii) Nellore       viii) Prakasham ix) Chittoor and Non-Operational Units of i) Nellore Zone ii) Vizianagaram Zone iii) Vijayawada Zone and iv) Kadapa Zones.

C) List of Unions contesting in the Operational Regions of i) Hyderabad  ii)Secunderabad iii) Nalgonda iv) Mahaboobnagar v) Medak vi) Rangareddy  vii) Karimnagar viii) Adilabad ix) Warangal x) Khammam xi) Nizamabad and Non-Operational Units of i) Head Office ii) Karimnagar Zone and  iii) Hyderabad Zone.

          The following further instructions are issued for strict compliance by all the Unit Officers.

1.            The employees who were transferred and relieved before the date of election have to cast their vote only at the Unit/Depot to which they were transferred, irrespective of their reporting at the Unit/Depot.

2.            Retired/Resigned/Removed/Dismissed/Terminated employees are not eligible for voting. Employees under suspension would, however, be eligible to vote as they continue to be in service.

3.            Employees who are on Sick, leave/Long leave and EOL are eligible for voting.

4.            Employees re-instated into service with continuity of service and having more than 6(six) months of service as on the date of reckoning i.e. on 01.11.2012 are eligible. Employees re-instated afresh without continuity of service become eligible only in case they have put in a service of 6(six) months prior to the date of reckoning.

5.            A list of employees Transferred/Retired/Resigned/Removed/Dismissed/Terminated/ Expired after date of reckoning shall be submitted to the Dy. Commissioner of Labour concerned by 06.12.2012 so that the Dy. Commissioners of Labour concerned will provide final voters list to the Unions by 10.12.2012.

6.            All the Regional Managers and the Controlling Officers should guide the Unit Officers and ensure that the above lists are compiled correctly and submitted to the                     Dy.Commissioners of Labour concerned and also to the Unions on the stipulated dates, without fail.  The lists of employees of all Non-Operational Units, including the Civil Engineering Divisions and its Sub-Divisions shall be compiled by the Dy.CPMs of Zones and POs of the Regions concerned.  The Head Office Units shall be taken care of by the Personnel Officer-II.

7.            The Personnel Officers of the Regions and the Dy.CPMs of the Zones and Dy.CPM(A) in respect of Head Office Units should verify the Final list of employees being compiled by the individual Units both in the Operational and Non-Operational Units and ensure that the Dy.CPM(IR&W)/Chief Personnel Manager is informed of the compliance by 16.00 hrs., on  06.12.2012, without fail.

8.            All the Regional Managers/Executive Directors of the Zones are requested to monitor the progress periodically and ensure that the time frame is maintained by the Unit Officers under their control. 

9.            No material related to Union Membership verification shall be allowed to be displayed in the premises of the Corporation or on the Notice Boards of the Recognised Union(s).

10.        Meetings of participating Unions within the premises of Depots/Bus Stations/ Offices/ Production Units/ any other premises of the Corporation shall not be permitted.

11.        Display of banners or hangings or tying and fixing banners on Buses, water tanks and other structures etc., of APSRTC and in or over the Corporation’s vehicles is prohibited.

12.        Requisition may be made to the local Police Officials one week before the date of election for providing sufficient Police Bandobust on the day of election i.e. 22.12.2012 to avert any untoward incidents.

13.        Canvassing within 24 hours of the commencement of the poll and at the Polling Stations is prohibited.

14.        All those employees who are eligible to vote in the election shall be advised to carry their Identity Cards (issued by the APSRTC) invariably, while going to polling booth for casting their votes, as it would be helpful to the Returning Officer for easy identification of the employee.

15.        Cell Phones, Cameras, Tablets and other electronic gadgets etc., are prohibited to be carried into the polling booths.

16.        All Unit/Depot Managers are advised to arrange a convenient place to the                       Dy. Commissioner of Labour/ Returning Officer (DCL/ACL) / Presiding Officer for the purpose of arranging Polling Booths.  Necessary tables/chairs/benches may be provided and drinking water shall be arranged.

17.        Postal Ballot will be provided only to those workers who will be away on duty on the date of secret ballot and thereby will not be able to exercise their votes between 5.00 AM and 6.00 PM on 22.12.2012. As per the letter 4^th cited the postal ballot will be held on 27.12.20102 & 28.12.2012.  Thus –

(i)      the employees who will be away from Head Quarters on duty between 5.00 AM and 6.00 PM on 22.12.2012 will be allowed to exercise their vote in the office of the      Dy.Commissioner of Labour and Dy. Returning Officer concerned between 10.00 AM to 2.00 PM on  27.12.2012; and

(ii)    the employees who  will be away from Head Quarters on duty on 22.12.2012 and also on 27.12.2012 (i.e. both days) will be allowed to exercise their vote on  28.12.2012 in the Office of the Dy. Commissioner of Labour and Dy. Returning Officer concerned between 10.00 AM and 02.00 PM.

Therefore, for the purpose of Postal Ballot, the lists of such employees i.e. (a) who will be away from Head Quarters on duty on the day of secret ballot, i.e.,  between 5.00 AM and 6.00 PM on 22.12.2012; and  (b) who will be away from the Head Quarters on duty on  the day of secret ballot (i.e. on 22.12.2012) and also on the day of  postal ballot i.e. on 27.12.2012 -- shall be submitted to the Dy.Commissioner of Labour and Dy. Returning  Officer concerned by 2.00 PM on 22.12.2012 itself through the respective  Presiding Officer at the respective Units/Depots by the Unit Officers, who prepared and submitted the Primary lists of employees  to the DCLs, duly supplying copies of the same to the contesting Unions on 22.12.2012 itself.

The Depot Managers/Personnel Officers of the Regions in case of Operational Units, the Dy.CPMs of the Zones in respect of Non-Operational Units of the Zones, PO-II/HO in case of  Head Office, PO/BBW in case of BBW&PP, Principal/ Transport Academy, Hakimpet and PO/Tarnaka Hospital, may contact the Asst. Commissioner of Labour concerned in advance on the arrangements, if any, to be made for the Postal Ballot.

Immediately after counting of votes is completed, the Depot Managers/Unit Officers of Operational and Non-Operational Units shall furnish the details of the votes secured by each of the participating Unions under Clause(3) and Clause(6) of Code of Discipline, separately over Telephone to the respective RMs/EDs(Zones). It is also advised to inform the number of employees eligible for postal ballot to the RMs/EDs(Zones). The RMs/EDs shall in turn inform the results of the Operational Unit/Non-Operational Unit (Unit-wise) through Phone Nos.27615220/27684325/27611260 immediately after completion of counting of secret ballot together with the details of number of employees eligible for postal ballot to the Dy.CPM(IR&W), MD's Office, Hyderabad FAX No.27616268 and place in RTC WAN(CPM folder - file name/Results 2012 - Unit name) in the following proforma.  They should also inform the Depot-wise/Unit-wise (operational/non-operational) information to Dy.CPM(IR&W) through special messenger to reach by 24.12.2012.

                        The Personnel Officers of Regions/Dy.CPM Zone concerned shall organize a communication cell at the respective Units in order to obtain information from the Units/Depots in order to flash the information to Head Office.

Dy. Chief Personnel Manager (IR&W) shall organize a Special Communication Cell in his Office on Telephone Nos. 27615220/27611260, Hyderabad from 5.00 a.m. onwards on 22.12.2012 to monitor the information and to ensure prompt communication of any clarification requested by the Unit Officers.
