        The Returning Officer & Joint Commissioner of Labour, Hyderabad (TCs) convened a meeting on 12.08.2010 with the Management of APSRTC and the Trade Unions functioning in APSRTC to finalize the election program for verification of Union Membership.  The following are the Unions recognized by the Labour Department to participate in the Union Membership verification.

 

1. APSRTC Employees’ Union  (Regd.No.215).

2. APSRTC Karmika Parishad (Regd.No.G-1430).

3.    APSRTC Karmika Sangh (Regd.No.B.995).

4.    APSRTC National Mazdoor Union (Regd.No.3108)

5.    APSRTC Rastriya Mazdur Federation, (Regd.H-117)

6.    APSRTC Staff & Workers’ Federation (Regd.No.B.891)

7.    APSRTC Staff & Workers Union (Regd.No.3155)

8.    Road Transport Corporation Workers Union ( Regd.No.C-2096)

9.    The APSRTC United Workers Union (Regd.No.G-2778)

 

2.      PROGRAMME OF UNION MEMBERSHIP VERIFICATION:

 

As per the program finalized by the Returning Officer & Joint Commissioner of Labour, Hyderabad (TCs), the Secret Ballot to determine the majority Union in the Corporation will be held on 09.09.2010 between 5.00 A.M and 6.00 P.M and Postal Ballot will be held on 14.09.2010 & 15.09.2010 from 10.00 A.M. to 2.00 P.M.

 

3.     RECKONING DATE:

 

        The Labour Department fixed the date of reckoning as 01.06.2010.  Therefore, the list of all the employees, except Officers, Class-II Supervisors and Security Staff, shall be prepared as specified hereunder, i.e. employees who are on the muster rolls of the Corporation as on 01.06.2010 and having six months of continuous service as on 01.06.2010 shall be listed out for the purpose of verification.

 

4.     PREPARATION OF LIST OF EMPLOYEES:

 

        Considering the representation made by the APSRTC Class II Supervisors Association, the Returning Officer & Joint Commissioner of Labour, Hyderabad (TCs) has directed to exclude the names of Supervisors from the Voters list. Therefore all the Class II supervisors are to be excluded from the voters’ list. Further the Returning Officer has declared that the workers directly engaged by the Management on contract basis are entitled to vote provided they are engaged by the management for a continuous period of 6 months or more immediately preceding the date of reckoning. Therefore all the Drivers and Conductors who are engaged on Contract basis on or before 01.12.2009 and continued to be on rolls as on 01.06.2010 are also entitled to vote. Thus the Voter’s list is to be prepared keeping in view the following:

 

a)                Minimum six months continuous working by the incumbent in APSRTC prior to the date of reckoning (i.e.01.06.2010) has to be considered for inclusion in the list of employees.

 

b)                All categories of workmen, except Class-II Supervisors and Security Staff, shall be included this time, irrespective of their membership in the Union, since muster rolls have been taken as the basis for primary list of employees.

 

c)                 All regular employees (permanent or temporary)/ Casual employees/ Employees working on Contract Basis/ Consolidated wage employees who have joined the service on or before 01.12.2009 and put in minimum of six months continuous service as on 01.06.2010 and are on rolls as on 01.06.2010 are eligible to be included in the primary list of employees.

 

d)                Casual employees/Employees working on contract basis  who have joined the service on or before 01.12.2009 and not put in minimum of six months continuous service as on 01.06.2010 due to disengagement in between 01.12.2009 and 01.06.2010, though they are on rolls as on 01.06.2010 are not eligible to be included in the primary list of employees.

 

e)                All regular employees who have joined the service on or before 01.12.2009, but removed from service before or after 01.12.2009 and subsequently reinstated into service with continuity of service before 01.06.2010 and on rolls as on 01.06.2010 are eligible to be included in the primary list of employees.

 

f)                  All the regular employees who have joined the service on or before 01.12.2009 and are on extra-ordinary leave and on rolls as on 01.06.2010 are eligible to be included in the primary list of employees.

 

g)                All Casuals/Employees working on contract basis/ Consolidated wage employees who fulfill the above conditions and whose salaries are being drawn through Pay Order are also to be included in the list of employees.

 

h)                All Casual/Employees working on contract basis/ Consolidated wage employees who have put in six months continuous service as on 01.06.2010 and on the rolls of the Corporation as on 01.06.2010, but disengaged subsequently are also eligible to participate in the Secret Ballot.

 

i)                  All the Unit Officers of the Operational Units as well as Non-Operational Units shall submit a list of employees compiled on the above lines from out of the muster rolls of the Units in the following proforma.

j)      The employees of Headquarters Enforcement Squad, Hyderabad whose Offices are situated at the places other than Hyderabad, will be permitted to vote in the Depots where their Offices are located. However, the employees of the Headquarters Enforcement Squad, Hyderabad located at Head Office, will be allowed to vote at Hyderabad (Non-Operating Unit, Head Office).

 

k)    The Personnel Officer-II is, therefore, advised to prepare the list of all such employees who are working at Headquarters Enforcement Squad branches located at other places, place-wise, separately, and send the same to the Depot Managers where the Squad Offices are functioning, to enable them to submit this list also, along with the lists of their employees to the Asst. Commissioner of Labour, concerned.

 

l)      Twelve (12) copies of the list of the employees working in Operational Units so compiled shall be submitted to the Asst. Commissioner of Labour as per the jurisdiction as furnished in ANNEXURE-I,  so as to reach him on or before 19.08.2010.  The Unit Officer in case of Non-Operational Units shall prepare the primary list of employees of their Units and send it to the concerned Dy.CPM of the Zone, to enable to submit the consolidated lists to the Asst. Commissioners of Labour concerned, on or before 19.08.2010.  In case of Head Office Non-operational Units, the lists have to be sent to PO-II for consolidation and submission to the Asst. Commissioner of Labour concerned, on or before 19.08.2010.   Two copies of these lists shall also be sent to each of the participating Unions by 19.08.2010.  Thus, total 30 copies of the employees lists shall be prepared by the Depot Managers/Personnel Officers in respect of Operational Units and Dy.CPMs in respect of Non-Operational Units and Personnel Officer-II in case of Head Office Units.  Soon after submission of the list of employees to the Asst. Commissioners of Labour concerned and the Unions, the Personnel Officers in respect of Operational Units and the Dy.CPMs in respect of Non-Operational Units and Personnel Officer-II in respect of Head Office Units shall send compliance to the Dy. Chief Personnel Manager (IR&W), Head Office, through FAX (No.27616268) by 14.00 hrs. on 19.08.2010 certain, duly furnishing the details of total complement.  All the Unit Officers are advised to exercise extreme care and caution while preparing the lists as per the above guidelines, duly checking whether the employees have got a minimum of 6 months continuous service in APSRTC as on the date of reckoning, i.e. 01.06.2010.

 

m) Some of the Operational and Non-Operational Units are coming under the jurisdiction of one or more Asst. Commissioners of Labour.  Therefore, to have clarity, a list indicating the Asst. Commissioners of Labour, to whom the Units have to submit the list of employees in each Operational and Non-Operational Units, is given at ANNEXURE-I. A lot of changes have occurred in the jurisdictions of ACLs. As per the information obtained from

 

n)    Commissioner’s Office, the Jurisdictions are furnished in the ANNEXURE-I. Therefore, the Dy.CPMs and the POs concerned are advised to ensure from the respective ACLs before 16.08.2010 about their jurisdiction.

 

o)    Twelve (12) copies of the list of employees, who are transferred from the Depot/Unit/Office to the other Depots/Units/Offices and vice-versa after the date of reckoning i.e. 01.06.2010, shall be furnished by each Unit Officer to the Asst. Commissioner of Labour concerned by 27.08.2010.  If no transfers have taken place in the Depots/Units/Offices, a NIL report in that regard shall be submitted to the Asst. Commissioner of Labour concerned, by 27.08.2010.  Two copies of this list/NIL report shall also be sent to each of the participating Unions by 27.08.2010.    

 

      A compliance report on the submission of Lists to the Asst. Commissioners of Labour concerned and the Unions, shall be sent to the Dy. Chief Personnel Manager (IR&W), Head Office, by FAX (No.27616268) before 14.00 hrs., on 27.08.2010 certain.

 

p)    Twelve (12) copies of list of employees who are retired/resigned/ removed/dismissed/terminated/expired from service and also fifteen (15) copies of list of Casual employees whose names were deleted from the Approved Panel/Select List during the interregnum period between 01.06.2010 and 27.08.2010, shall be prepared and submitted by the Unit Officers to the Returning Officer, viz. Asst. Commissioner of Labour on 27.08.2010, as SUCH EMPLOYEES ARE NOT ELIGIBLE TO VOTE.  If there are no such cases, a NIL report in that regard shall be submitted to the Asst. Commissioner of Labour by 27.08.2010.  Two copies of this list/NIL report shall also be sent to each of the participating Unions by 27.08.2010

 

      A compliance report on the submission of lists to the Asst. Commissioners of Labour concerned and the Unions shall be sent to the Dy.Chief Personnel Manager (IR&W), Head Office by Fax (No.27616268) before 14.00 hrs. on 27.08.2010 certain.

 

q)    Retired/resigned/removed/dismissed/terminated/expired employees and Casual employees, whose names were deleted from the Approved Panel/Select List are not eligible for voting.  Employees under suspension would, however, be eligible to vote as they continue to be in service.

 

r)      All the employees who were transferred and relieved before the date of election have to cast their vote only at the Unit/Depot to which they were transferred, irrespective of their reporting at the Unit/Depot.

 

s)    All the Regional Managers and the Controlling Officers should guide the Unit Officers and ensure that the above lists are compiled correctly and submitted to the Asst. Commissioners of Labour concerned and also to the Unions on the stipulated dates, without fail.  The lists of employees of all Non-Operational Units, including the Civil Engineering Divisions and its Sub-Divisions shall be compiled by the Dy.CPMs of Zones and POs of the Regions concerned.  The Head Office Units shall be taken care of by the Personnel Officer-II.

 

t)     The Personnel Officers of the Regions and the Dy.CPMs of the Zones and Dy.CPM(A) in respect of Head Office Units should monitor the information being compiled by the individual Units both in the Operational and Non-Operational Units and see that the Dy.CPM(IR&W)/Chief Personnel Manager is informed of the compliance by 14.00 hrs., on  19.08.2010 and again on 27.08.2010, without fail.

 

u)    The Officers who are responsible to prepare the lists of employees as advised above are authorised to incur expenditure towards the Stationery required for preparation of the lists of employees, mentioned as above, up to Rs.1,000/- (Rupees one thousand only).

 

v)    All the Regional Managers/Executive Directors of the Zones are requested to monitor the progress periodically and ensure that the time frame is maintained by the Unit Officers under their control.
