        Clause(1)(i) Regulation 30 of APSRTC Employees’ (Recruitment) Regulations, 1966 stipulates that where it is necessary in the administrative interest to fill in case of administrative exigencies a vacancy in a post borne on the cadre of a higher category in a service or class by promotion from lower category and if the filling of such vacancy in accordance with Recruitment Regulations is likely to result in undue delay, the appointing Authority may promote a person temporarily otherwise than in accordance with the said Regulations. 

        Clause (3) of Reg. 30 of Recruitment Regulations says that a person promoted under Sub-Clause (i) of Clause (1), whether he possesses the qualification prescribed for the service, class or category to which he is promoted, shall as soon as possible, be replaced by a member of the service who is eligible to hold the post under the Regulations or orders in force.  

        Instructions were issued through Circular 2nd cited advising the appointing authorities to replace employees promoted under Reg. 30 with eligible candidates selected by appropriate Selection Committees and not to resort to temporary promotions as a matter of routine. The instructions have been reiterated through the Circular 3rd cited duly prescribing the time limit of  3 months for replacing the employees working under Regulation 30 with eligible candidates selected by appropriate Selection Committees. 

In addition to the above the following instructions are issued for strict compliance. 

 

1.    The Promotions under Regulation 30 shall not be resorted to except in rarest  of rare cases in administrative exigencies

       

2.    The promotions are to be ordered twice in a year i.e., in January and July of every year on regular basis. Inspite of giving  promotions in January and July of every year, if the  administrative exigencies  demand,  promotions can be ordered whenever such situation arises

 

3.    The panels have to be built up with 10% buffer in order to cover rejection of promotions or any other unforeseen eventualities

 

4.    In terms of Circular 4th cited, the MRRs  should be sent by the initiating Officers by 15th April of every year to countersigning Officers without fail and the Countersigning Officer shall send the same to the accepting authority/custodian Officer by 22nd April without fail. The Custodian Officer should ensure that all MRRs reach his/her Office on or before 1st May of every year. If the MRRs are not received in time from the rating Officers, it is the responsibility of the custodian of MRRs to propose suitable action on the concerned besides stopping the annual increment and ensure receipt of MRRs  in time

 

5. The seniority lists in the applicable feeder posts are to be maintained meticulously without fail at Head Office, Zones and Regions. Inspection of Seniority lists is to be carried periodically by the inspecting officials

                                                                               

6.    Wherever candidates with qualifying service are not available, service relaxation for not more than one year should be given by the concerned EDs in case of those categories for which EDs are authorized to fill up the vacancies as per letter 5th and 6th   cited. In   such cases also the promotions shall   be ordered on regular basis through Selection committees   duly following the Communal roster. They need not be placed under Regulation 30 till they fulfill the requisite length of service

 

The deviations from the above instructions will be viewed seriously.
