        Corporation is not attracted by the provisions of Payment of Bonus Act, 1965.  However, Ex-gratia is being  paid after obtaining approval of the State Government.

        The Government vide reference 2nd cited, have communicated approval for the payment of Ex-gratia to all eligible Employees of the Corporation including Ex-TTD Employees (non-optees subject to the outcome of SLP before Supreme Court) whose Pay + DA does not exceed Rs. 3500/- p.m including all arrears of Pay etc. @ 8.33% on Pay + DA limiting the payment to Rs. 2500/- for the year 1996-97.

        Accordingly the following working instructions are issued for preparation of Ex-gratia bills for the year 1996-97 and for arranging payment.

    1)    Any Employee whose Salary/Wage (Pay + DA) does not exceed Rs.3500/- per month and Rs. 42,000/- per annum is eligible for Ex-gratia for the year 1996-97.

    2)    Salary/Wage (Pay + DA) for any month includes arrears of Pay, DA Increments, FP Increments drawn during that month irrespective of the month of which wages/arrears pertain.

    3)    a)    Where the Salary/ Wage (Pay + DA) of an employees does not exceed Rs. 2500/- for any month in 1996-97,

Ex-gratia shall be calculated at 8.33% on Pay + DA for that month.

            b)    Where the Salary/ Wage (Pay + DA) of an employees is in between Rs.2500/- and Rs. 3501/- for any  month in 1996-97, the Ex-Gratia shall be calculated as if his/her salary were Rs. 2500/- only and Ex-gratia shall be calculated at 8.33% on Rs.2500/- p.m. only for that month as illustrated at Appendix -A.

    4)    In case of an Employee whose Salary/ Wage (Pay + DA) is Rs.3500/- less for few months and more than Rs. 3500/- for remaining months in 1996-97 Ex-Gratia shall be calculated  for the months for which Salary/Wage Rs. 3500/- or less only as illustrated at Appendix -B.

    5)    The total amount of Ex-Gratia payable shall be limited to Rs. 2500/-

    6)    An employee whose Salary/ Wage (Pay + DA) exceeds Rs. 42000/- per annum for the year 1996-97 is not eligible for Ex-gratia even though his Salary/ Wage (Pay + DA) for any particular month in the year is less than or equal to Rs.3500/- as illustrated at Appendix -C.

    7)    Ex-Gratia shall be calculated on month to month basis as shown in the Appendices.

    8)    Payments shall be allocated to A.H.No.58s of respective groups.

    The following Employees are eligible to receive the Ex-gratia :

        i)    Casuals engaged on daily wage rate basis, provided they worked for not less than 30 working days in the year 1996-97.

       ii)    Employees appointed on contract basis (engaged daily / monthly rate basis), provided they worked for not less than 30 working days in the year 1996-97.

      iii)    Daily rated work charged Employees in Civil Engineering Department, provided they worked for not less than 30 working days in the year 1996-97.

    iv)    Works Inspector (Technical) and Works Inspector (Non- Technical) to whom no time scale of pay and allowances are given, provided they worked for not less than 30 working days in the year 1996-97.

     v)    Employees who retired/resigned/expired during the year 1996-97  if they are otherwise eligible.

    vi)    Asst. Medical Officers appointed on contract basis provided they worked for not less than 30 working days during the year 1996-97.

        The following Employees are not eligible for Ex-gratia  :

    i)    Officers / Deputationists.

   ii)    Apprentices, Traffic / A. Grade Mechanical Apprentices / Officers Under Training except those who are departmental candidates appointed as Apprentices to whom appropriate amount shall be drawn for the period of their service as regular Employees before the date of appointment as Apprentices / OUTs.

  iii)    Employees who have worked for more than 30 working days in the year 1996-97 but are under suspension or on long leave or absent on the date of payment of Ex-gratia may be paid the eligible Ex-gratia after they resume duty.

        All the Unit Officers (Salary Drawing Officers) are hereby advised to arrange payment of Ex-gratia to all eligible Employees of the Corporation including all eligible Ex-TTD Employees (Non-optees) for the year 1996-97 duly pre-audited on or after 10.09.1997.

        All Dy.CAOs/AOs of Pay Roll Processing Centers are advised to make arrangements for collection of Software from STO(DP) JBS, Picket at once.

        This has the concurrence of Chief Accounts Officer.
