         There is a typographical error vide  Para No.4 (xiv) of the Circular cited.  The same may be read as follows:

 

xiv)                  The working period of outsourced activity be reckoned from 21st of previous month to 20th of current month (both days inclusive). The Contractor/Outsourcing Agency shall present the bill in time as specified in the agreement. On receipt of the Bill, the concerned Officer of the Corporation shall ensure payment of remuneration by 1st of every month.

1)               Of late, it has been observed that the shortage of Supervisors in all wings at Depots is steadily increasing on account of large no. of Retirements and consequential vacancies arising on account of Promotions.  Shortage of Supervisors is resulting in operational inefficiency, commuter dissatisfaction, failure in redressal of Grievances.  

2)                  In order to tide over the situation,  it is decided to outsource the work of Supervisory categories at all Depots wherever there is shortage by  outsourcing through Manpower Agencies, to engage Supervisors who retired on superannuation from Passenger Transport Organisation having a fleet strength of more than 1000 vehicles, having experience of more than 5 years in supervisory category equivalent to Class-II  Service in APSRTC till such time the vacancies are filled up by Direct Recruitment/Promotions. 

3)                  The following guidelines are issued for Outsourcing the Supervisory categories.  

a)    The ED/Zones shall take action to fill up the existing vacancies (as per sanctions communicated by Head Office) in Supdt/Dy.Supdt. levels in all Departments by promotion duly following the procedure prescribed in APSRTC Employees’ (Recruitment) Regulations 1966 and Circular instructions issued from time to time. 

b)    In case the vacancies are not filled, wherever candidates with qualifying service are not available, service relaxation for not more than one year shall be given and their cases shall be considered for promotion on regular basis through Selection Committee duly following Communal Roster in terms of instructions communicated through Circular No.PD-47/2010, dt.9.9.2010.  

c)     On completion of action on Item (a) & (b), if vacancies exist in Supervisory cadres at Depots, the ED/Zones may take action and permit Regional Managers to utilize lower Supervisory cadres (i.e., vacancies in the cadre of Asst. Managers and equivalent rank with lower categories of Supdts. & Dy.Supdts.  Similarly, the vacancies in the cadre of Supdts. with Dy.Supdts. cadre and equivalent rank against the vacancies). 

d)  Corporate Office shall take action to fill up the vacancies of 1st level Supervisor Categories of all Departments by promotion as per inter-seniority. If the vacancies are not filled on account of non-availability of eligible candidates, permission will be communicated to Zones to utilise the lower supervisory categories till such time the vacancies are filled with eligible candidates by promotion. 

e)     Even after taking action on item (a), (b), (c) & (d), if still there are vacancies in Supervisory cadres, the Regional Managers may be permitted to take action to outsource the vacancies by engaging Supervisors who retired on superannuation in respective disciplines from a Passenger Transport Organisation having a fleet strength of more than 1000 vehicles, through Manpower Agencies by calling open Tenders. 

f)        However this will not preclude the Authorities in conducting the selections on time. 

4)                   i)  The Dy.Chief Personnel Manager/Zones shall assess the vacancy position of Supervisory cadres of all Departments at all Depots as against the sanctioned posts communicated by Corporate Office and communicate permission to outsource the activities. 

ii)   Tenders shall be called for by the Regional Managers for the required number of Supervisors to be outsourced at Depots of the Region.   The number of Supervisors to be outsourced shall be specified in the Tender Notification and in the Terms and Conditions of the Tender application. 

iii)     The minimum value of the contract shall be assessed based on the following three components: 

(a)          The remuneration payable to the Supervisors under this Scheme is Rs.9000/-.  

 b)  The remuneration shall be paid to the supervisors by the agency through Bank Accounts and the supervisors supplied by agency shall invariably furnish their Bank Account numbers, so that in case of complaints it can be verified for improper payments.

      c)   No statutory contribution like PF, EDLIF and ESI shall be paid in respect of such retired Supervisors who fall under the definition  of exempted employee as per PF Act. 

 d) Over and above the value of the aforesaid components, a minimum profit margin of 7% may be considered to be allowed for the Contractor/Agency. 

iv)                       It should be clearly mentioned in the Notification that, if any Contractor quotes less than the above estimated value, such a quotation will automatically be disqualified and the Tender Committee shall not consider such quotation at any cost. 

v)                        In case, there are more than one Tenderer quoting the same lowest amount, allotment of contract shall be made on the basis of the Lottery. 

vi)                       The Tenderer should pay EMD amount @ 2.5% of the total notified value of the work-contract along with Tender Application through DD. 

vii)                      Successful Tenderer shall have to pay Security Deposit equivalent to One months’ contract amount within fifteen days from the date of allotment of tender.  

viii)                   The Retired Supervisors deployed by the Contractor/Agency are entitled for wages on Sundays and other Festival/Public Holidays declared for Offices/Units in APSRTC.  The Retired Supervisors outsourced shall have to strictly follow the timings allotted to them. The Unit Officers concerned where the Retired Supervisors are outsourced are authorized to change the timings based on the day to day requirement. 

ix)                       The Contractor/Agency should provide additional Supervisors as and when required on the same terms and conditions during the period of agreement.  In such cases the Security Deposit shall be enhanced and the differential Security Deposit shall be collected. 

x)                      The Successful Contractor/Agency should produce the bio-data of the persons, whom he proposes to deploy against the work, duly enclosing their willingness in writing to work with the particular agent, along with the Tender. 

xi)                       He should have working knowledge of Telugu, English and Urdu in the districts where Urdu is recognized as second official language by the Govt. of A.P. and Telugu & English in other districts. 

xii)                   The Contractor/Agency shall not change the Supervisors without prior approval of Regional Managers concerned. 

xiii)                    The Supervisors outsourced working in the Units / Offices are responsible and empowered to attend all nature of duties attached to the post on par with Supervisors working on regular basis. 

xiv)                   The working period of outsourced activity be reckoned from 21st of previous month to 20th of current month (both days inclusive). The Contractor/Outsourcing Agency shall present the bill in time as specified in the agreement. On receipt of the Bill, the concerned Officer of the Corporation shall ensure payment of remuneration. 

xv)                    The Contractor / Outsourcing Agency has to pay the wages to the Supervisors as prescribed at paras No.4(iii)(a) without deducting any statutory contributions like PF, EDLIF and ESI etc. as they fall under the definition of exempted employee as per PF Act.  Any deductions made by the Contractor/ Outsourcing Agency in violation of the instructions shall result in stringent action including termination duly protecting the interest of outsourced persons.  

xvi)                   The Unit Officer shall maintain the Attendance of the Supervisors engaged by the Contractor/Agency.  

xvii)               The Unit Officer shall certify the claim submitted by the Contractor/ Agency with reference to the Attendance of the Supervisor.  

xviii)                If any Supervisor absents on a particular day, the corresponding wages have to be deducted from the Contractor in monthly remuneration bill. 

xix)                   The Tools & Plants required for attending the assigned duties will be supplied by the Corporation.   

xx)                     In the event of the Contractor not supplying Supervisors continuously for 6 (six)  days  or not supplying prescribed number of supervisors for more than ten days in a period of Ninty days, the RM concerned can terminate the contract with a month’s notice.   In order to bridge the intervening gap of engaging another Contractor, the ED/Zone is empowered to engage any other Contractor/Agency on nomination basis at the old rates upto 6 months or till such time fresh tenders are called for and finalized whichever is earlier.  

xxi)                   The outsourced Supervisors shall be kept under the constant supervision of the Unit Officer / Supervisor concerned. 

xxii)                  The format of Tender Notice, Tender Conditions are at Annexures.

 5)      TENDER COMMITTEE:

a)  The following Committee shall be constituted to examine the Tenders and negotiate with Tenderers after short listing the tenders based on the total remuneration quoted and technical background of the Tenderer and finalizing the same. The decision of the Committee is final.

b)      The Tender Committee may observe the following while finalisation of Tenders. 

i)                  The Agency shall supply Supervisors who retired from Passenger Transport Organisation having a fleet strength of more than 1000 vehicles, having experience of more than 5 years in supervisory category equivalent to Class-II Service in APSRTC.                                                      

ii)       The agency who ever supplies more no. of Retired Supervisors  shall be selected as successful Tenderer. 

 Note:  Approval of Executive Director Concerned shall be obtained on the recommendations of Tender Committee Proceedings before allotting the work to the Contractor/Agency. 

6)         The retired Supervisors deployed by the Contractor/Agency must be below 65 years of Age as on date of filing Tender.  They must produce a fitness certificate issued from SMO/MO of APSRTC Dispensaries.

7)         EDs of the Zones are authorized to accord sanction for allotment of the above work contract to the successful contractor, recommended by the Tender Committee constituted for the purpose.  The period of contract shall initially be for a period of ONE year and extendable by one year each and not more than two years (total 3 years)  on similar terms and conditions and satisfactory performance of the Contractor/Agency or till such time the vacancies are filled by direct recruitment whichever is earlier.

8)         Before renewing the contract, the possibility of promoting regular employees shall be reviewed.  

9)                  The other instructions issued from time to time in calling for and finalizing of tenders for awarding of work-contracts shall be followed accordingly. 

10)              Either party reserves the right to terminate the contract agreement without assigning any reason whatsoever duly giving one month’s notice to the other party provided such notice is not issued within six months of commencement of the agreement. This clause shall in no way be interpreted to be in derogation of para 4(xx).

            Necessary action shall be taken accordingly.

2.                  Other things being equal, if more than one Tenderer quote lowest minimum amount of Monthly Remuneration and found suitable by the Tender Committee, the contract shall be allotted on the basis of LOTTERY.

TENDER CONDITIONS

 

 

1)         The successful bidder has to undertake the job of deployment of Supervisors Retired on superannuation from a passenger Transport Organization having a fleet strength of more than 1000 vehicles, having experience of more than 5 years in Supervisory category equivalent to Class-II service in the Units of APSRTC as specified in the tender application.

 

2)         The successful bidder has to furnish the list of his Supervisors proposed to be deployed by him for the contracted work, i.e. the list containing the Name, Father’s Name, Date of Birth & Age, Experience and Address of each Supervisor, to the Unit Officer/Dy.CPM:Zone concerned. He should also intimate in advance, the change of Supervisor along with the above details, if any, from time to time.

3)         The period of contract is One year from the date of agreement. Extendable             upto 3 years from time to time.

 

4)         Earnest Money Deposit is Rs.________/-

 

5)      The EMD prescribed should be paid through crossed Demand Draft drawn in favour of “Dy.Chief Accounts Officer/Accounts Officer, APSRTC, ___________Region” payable at _________ or Money Receipt can be obtained by paying EMD amount at the APSRTC Depot Manager’s Office ____________Depot.  In case of failure to enclose the Demand Draft or Money Receipt, as the case may be, in original to the Tender Form/Application submitted, the Tender Form/Application will be rejected.  The EMD amount shall not carry any interest.

13)                   The sealed cover should be placed in a tender box, kept in the office of the Regional Manager, ____ upto 14.00 hrs on ___________.  The tenders received after the stipulated date and time will not be accepted.  Tenders will  be opened at _____ hrs., on the same day by the Tender Committee.

 

14)                   Tender Forms not accompanied by the Demand Draft/Money Receipt, as the case may be, in original towards the requisite EMD; incomplete filled tender forms, Tender form without signature and without Terms & Conditions with signature on each page will be rejected. 

 

15)                   Tender forms with any pre-conditions or additional conditions other than the conditions prescribed by APSRTC will summarily be rejected.

 

16)      If the successful tenderer fails to take up the work within the period of two weeks the EMD will be forfeited.

17)      The successful tenderer shall enter into an agreement for undertaking the work on prescribed terms and conditions.

 

18)      The successful bidder to whom the contract will be allotted shall have to undertake the contract for a minimum period of ONE YEAR from the date of entering into an agreement.  If he desires to discontinue the contract for whatsoever reasons, before completion of minimum period of contract,  the Security Deposit will be forfeited in favour of the Corporation.

 

19)      The Contract shall be terminable with ONE month’s advance notice by either party after completion of six months.

20)      The successful tenderer (allottee) has to pay Security Deposit which is equivalent to ONE MONTH Remuneration, in cash and enter into an agreement with the Corporation (Regional Manager), failing which allotment is liable for cancellation and the EMD paid by him shall be forfeited to the Corporation without any further notice/ intimation.  Security Deposit will not carry any interest.

 

21)       The remuneration will be paid to the successful bidder every month by the Corporation. The successful bidder shall pay remuneration to the Supervisors through Bank Accounts only and shall submit statement of payment to Corporation.

 

22)       Payment of monthly remuneration will be made only on submission of proper claim duly certified by the Unit Officer/ Incharge Supervisor with reference to day to day work carried out by the Contractor/Agency.  The Unit Officer/Incharge Supervisor should maintain a Register recording the attendance of the outsourced Supervisors and works carried out.

 

23)       In the event of death of Contractor, the contract shall come to an end. However, the Corporation may permit the Legal Heir of the contractor to run the contract on the same terms and conditions for the remaining period of Contract on execution of fresh deed of agreement by such legal heir.

 

24)       The contractor should not engage Supervisors below the age of 18 years and above the 65 years of age for the work.

 

25)       The Contractor/Agency shall not change the Supervisors without prior approval of the Unit Officer / ED Zone concerned.

 

26)       The Supervisors deployed by the Contractor have to strictly follow the Office   timings allotted to them as applicable to regular employees.

   

27)       The Contractor/Agency has to pay the remuneration of Rs.9000/- P.M to the Supervisors engaged  by him.

The Contractor/Agency is responsible for any objections or disputes raised either by the Labour Dept., or the Supervisors on any payments to be made to the Supervisors and on any penalties levied by the Government.

 

28)       The contractor is liable for any obligation arising out of his contract in respect of Supervisors engaged by him.

29)       No compensation shall be paid by the Corporation for any injury or death of the Supervisors engaged by the contractor within the premises of the contract area.  The contractor is liable to bear all expenses and compensation in such cases.  The contractor shall satisfy the ANDHRA PRADESH STATE ROAD TRANSPORT CORPORATION with regard to the arrangements made by him to fulfil his obligation arising out of this clause by way of an Insurance Policy.

 

30)       The contractor has to contact the Labour Dept., and to maintain the registers as required under Law and as required by the Corporation and the same have to be produced for verification of the inspecting officials.

 

31)       The contractor has to obtain license from the Licensing Officer under “Contract Labour (R&A) Act, 1970” to carry out the  work contract in question in the contract area in the Establishment of _______ and submit a copy of  the same to the Unit Officer/Dy.CPM:Zone concerned before commencement of the contract.

 

32)       The contractor has to comply with all the provisions of the Acts of Government relating to Labour and Rules and Regulations made there-under from time to time, like Payment of Minimum Wages, Provident Fund, EDLIF, ESI, Weekly Off etc., as prescribed by the State Govt., from time to time and submit the proof of compliance along with the Monthly Bill to the Unit Officer/ Dy.CPM:Zone concerned for payment.  He has to indemnify the Corporation all the claims, damages for compensation under the provisions of all Laws and Acts pertaining to the Labour.

 

33)       The Security Deposit is refundable on the expiry of the period of Contract without interest and subject to the performance and fulfilment of agreement conditions.

 

34)    (a) The Security Deposit paid by the contractor is liable to be forfeited in the    event of non-commencement of work contract after depositing Security Deposit within the stipulated time as per the allotment order or breach of any of the terms and conditions of the tender form besides termination of contract.

 

             (b) The Security Deposit amount is liable to be forfeited in the event of non-submission of deed of Contract after payment of the security deposit amount and commencement of service contract.

 

35)       The Security deposit is liable to be forfeited in case the contractor fails to execute the contract for the period agreed to under the contract.

 

36)       The monthly bill of the contract amount shall be paid to the contractor only after submission of proof about payment of Service Tax at the rates prescribed from time to time and its remittance to the Authorities concerned.

37)       The contractor is liable to pay the damages, if any, caused to the premises or movable and immovable property of the Corporation, by him or by his agents or representatives as determined by the Unit Officer/ Dy.CPM:Zone.  The Unit Officer/ Dy.CPM:Zone concerned shall have the right to recover such amounts towards the damages caused from the monthly remuneration or Security Deposit of the contractor. In case the amount is recovered from the Security Deposit, the contractor is liable to recoup the same immediately.

 

38)       Any violation or breach of terms and conditions of the contract including unsatisfactory maintenance of contract work shall render the contract liable to be terminated duly forfeiting the Security Deposit.

 

39)       The Corporation shall have right to terminate the contract with a month’s notice, if in its opinion the work of contractor is not satisfactory and its decision in this regard shall be final.

 

40)       The Security Deposit is liable for forfeiture in case the contractor terminates the contract without giving one month notice to the Corporation.

 

41)       The contractor shall insure the lives of the Supervisors engaged by him for any eventual risks that might crop up in the event of any accident and it shall be the sole responsibility of the contractor to meet all the claims/compensation for disability or loss of life of the labour.

 

42)       The contractor is liable for imposition of penalties upto Rs……. , in case of complaints from the staff, officers and public on maintenance of work and the same will be deducted from the remuneration or the Security Deposit, as the case may be.  In case, the amount is deducted from the Security Deposit, the contractor is liable to recoup the same immediately.  Otherwise, the contract is liable for termination duly forfeiting the Security Deposit.  Penalties can be levied by the authority who enters the agreement (i.e. Unit Officer/ Dy.CPM:Zone) or any higher authority. 

 

43)       The Rights given under the Contract are not transferable.          

 

44)       The contractor is not permitted to sub-let the contract work to any other sub-contractor.

 

45)       In all disputes, in case of doubts or interpretation of clauses of conditions and applications of this contract or otherwise, the decision of the Managing Director,  Andhra Pradesh  State Road Transport Corporation shall be final.

 

46)       The Supervisors employed by the contractor/or the contractor himself shall not have any right or claim whatsoever for employment in the Andhra Pradesh State Road Transport Corporation at a future date.

47)       In case of misbehaviour, assault on employees of the Andhra Pradesh State Road Transport Corporation by the contractor or his representatives/workers it will lead to imposition of penalty or termination of contract duly forfeiting the Security Deposit and Criminal action.

 

48)       The Management reserves right to reject any or all tenders without assigning any reason thereof.  The Management also reserves the right to allot the contract to any person of its choice through negotiations with the tenderers after justifying their ability to comply with the Labour Laws viz. Payment of Remuneration, Service Tax etc.

 

49)       The contractor should adhere to all acts and laws enforce applicable to his business and for any violation of such laws the sole responsibility lies with the Contractor.

 

50)       In the event of any statutory authority imposing any punishment like fines etc, and if the Corporation is made a party in such penal action, the Corporation has got the authority to keep and recover such amount due to contractor like remuneration/security deposit etc., with it until it is proved to the satisfaction of the Corporation that such penal actions are ceased. Such actions may also be reason for termination of contract.

 

51)       On the expiry of the period of licence or on its termination, as the case may be the contractor shall handover the equipments supplied by Department if any to the Unit Officer concerned in good working condition.

 

52)       The contractor shall pay all the taxes including Service Tax under the Central and State Acts/Rules made there under, applicable to the business.  The Corporation is not liable for the penalties in view of non payment of taxes or default therein. Any default, non payment of taxes to statutory authorities will cause termination of Contract.

 

53)       The Tender Committee reserves the right to alter/modify the period of contract mentioned in the Tender Notice at the time of finalization of Tender.

 

54)       All the above terms and conditions will form part of the agreement of the Contract and the contractor will be bound by the conditions in addition to any other conditions prescribed by the Corporation from time to time.

 

55)       Income Tax as per the provisions of I.T. Act and other taxes if any will be recovered from the monthly payment and the contractor has to obtain the PAN Number from the Income Tax Department and the same is to be produced
