Sub: CONTRACTS – Allotment of work-Contracts on nomination basis in exceptional cases – Instructions issued – Reg.

Instructions were issued through circular 2^nd cited authorizing the RMs and ED(Zone) in respect of the Units under their control (ED(E&IT) in respect of the Units under the jurisdiction of the Head Office) to allot the maintenance contracts on nomination basis for a period not exceeding 3 and 6 months respectively till such time fresh tenders in respect of the said works are called for and finalized, which ever is earlier in the circumstances, where:-

 

(i)            the existing contractor abandons the contract abruptly, or

 

(ii)          the existing contract is withdrawn either by the Contractor due to his personal reasons or by the Management on administrative reasons (such as the contractor is not undertaking the work satisfactorily), duly giving requisite advance notice, or

 

(iii)         the existing contractor is not coming forward to continue the work for a further period on the remuneration offered by the Management.

 

          In order to avoid dislocation of maintenance works and for ensuring continuity of such contract works at the Depots/Units, Regional Managers are hereby authorized to allot the Maintenance Works on nomination basis upto 6 months, ED of the Zone in respect of the Units under his control and the ED (E&IT) in respect of the jurisdiction of Head Office upto one year or till such time fresh Tenders in respect of the said works are called for and finalized which ever is earlier.

 

In case, circumstances warrant to continue the nominated contractor beyond the above periods, prior approval of VC&MD in this regard shall be obtained duly processing the case through ED(E&IT).

  

The existing instructions contained in circulars at reference 1 and 2 above on the subject shall be deemed to have been modified with immediate effect to the extent indicated above.
