         Sub :-  SUITS - Filing of Petitions by the aggrieved Petitioners - Furnishing comments - Lapses in disposing off the legal cases - Instructions - Issued.

        As per instructions in vogue, the required information i.e., para-wise comments, relevant circulars, records/documents have to be furnished to the Legal Cell by the concerned Units on the Petitions/Suits filed against the Corporation.  In turn, the legal Cell, on receipt of information will send this to Standing Counsel to prepare writ Affidavits/Counters to be filed before the Court.

        Of late, it is observed that legal matters are either delayed or required attention is not being paid in putting forth the correct rule position/required defence.  When probed into, it was found that the reason for this state of affairs is the less attention being given to the legal matters.  Due to this basic lacunae, there is every possibility of not pleading the court properly and correctly thereby cases are disposed of unfavourably causing heavy financial losses to the Corporation.

        It is therefore essential to pay required attention to legal matters and to study the averments made by the petitioners in the Affidavits in depth and it is essential to furnish correct and appropriate rule/regulations position in the comments; which will utlimately help in a greater way our Standing Counsel in filling the counter as well as defending, the case.

        All the Unit Officers should prepare the para-wise comments with utmost deligence and send it to the Legal Department along with copies of the all the required documents.  The Personnel Officers/Dy. Chief Personnel Managers in the Regions/Zones should pay personnel attention the legal matters and defend the case.  If necessary, they have to contact the Standing Counsels personally and apprise him of the subject matter - throughly.

        Any lapses on the part of the Officers concerned will be viewed seriously.
